Douglas is one of the leading juniors in the very complex and specialist field of towns and village greens.
He appeared for the successful appellant in R (Beresford) v Sunderland City Council (2004) 1 AC 889, the decision in which the House of Lords, overturning the lower courts, held that the implied permission of a landowner was not capable or rendering use other than as of right.
He has also appeared, leading another member of chambers, in the important case of Oxford County Council v Oxford City Council & Robinson, both at first instance (2004) and in the Court of Appeal. This case raises a range of critical issues as to the determination and administration of applications to register land as a town or village green.
As well as appearing at many non-statutory inquiries concerning TVGs for landowners and applicants, Douglas is increasingly being asked by registration authorities to appear as inspector at such inquiries.
